Not at all an expert here, but I thought LA was gambling to flip the rule
With Kennedy retiring and being replaced by Kav, the balance shifted and LA thought they could get a different ruling. Kav was happy to be a stooge here, and Dem fears about his nomination were proven correct that he wouldn't simply follow Supreme Court rulings. Roberts showed true integrity by ruling differently from his ruling 4 years ago in order to maintain stare decisis.
The occasional checks on the GOP lately have been through the courts. And Roberts doesn't ask for a lot to let things fly by him, but he does have some integrity that he isn't willing to completely sell himself out for conservative rulings.
